These Terms of Service (the "Terms") are a binding agreement between you and KenesLab ("we", "us" or "our"), the operator of TR1. Please read them carefully. By creating an account, starting guest play, or otherwise using TR1, you agree to these Terms. If you do not agree, do not use the Service.
1. About these Terms
1.1 TR1 (the "Service") is a browser-based online game and the websites, features and support channels that go with it. The Service is operated by KenesLab, a sole proprietorship established in the Republic of Korea. Our contact details are set out in Section 20.
1.2 The following documents also apply to your use of the Service and form part of these Terms:
- our Code of Conduct, which explains the rules of behavior in the Service and how we enforce them; and
- our Privacy Policy, which explains how we handle your personal data. The Privacy Policy is provided for your information; it does not reduce your rights under data protection law.
1.3 If the Code of Conduct conflicts with these Terms, these Terms prevail.
2. Definitions
- "Account" means a registered member account, identified by an email address and password and/or a linked Google account.
- "Member" means a person who has registered an Account.
- "Guest" means a person who uses the Service through guest play under Section 5, without registering an Account.
- "Character" means an in-game character that you create and control in the Service.
- "Game Data" means the data generated through your use of the Service and stored on our servers, such as Characters, levels, progress, items, in-game currency and activity records.
- "Virtual Items" means in-game currency (such as gold), items and other digital content that can be used only within the Service.
- "Paid Services" means any part of the Service offered for a payment of money.
- "User Content" means anything you enter or post in the Service, including nicknames, Character names, community posts, reports and support messages.
3. Eligibility and age requirements
3.1 You must be at least 13 years old to use the Service. If you live in the European Economic Area (EEA) or the United Kingdom, you must be at least 16 years old. These requirements apply both to Members and to Guests.
3.2 By using the Service, you confirm that you meet these age requirements. We do not currently verify the age of users. If we learn that an Account or guest profile belongs to a person who does not meet these requirements, we will delete that Account or guest profile and its associated data.
3.3 If you are over the minimum age but under the age of majority where you live, you should review these Terms with a parent or legal guardian, and you may need their permission to make any purchase.
3.4 A parent or guardian who believes that a child under the minimum age is using the Service may contact us as described in Section 20, and we will delete the relevant data.
3.5 You may not use the Service if we have previously terminated your Account for a serious breach of these Terms, unless we have agreed otherwise in writing.
4. Your Account
4.1 You can register an Account with an email address and password, or by signing in with a Google account. When you register with an email address, we send a verification code to that address, and registration is completed only after you enter the code.
4.2 You must provide accurate information and keep it up to date. You can view and change some of your information, such as your nickname, in My Page. Some details, such as the email address used as your login identifier, may not be changeable.
4.3 Your Account is personal to you. You are responsible for keeping your login details secure, and you must not share, lend, sell or transfer your Account or let anyone else use it.
4.4 If you believe that your Account has been accessed without your permission, tell us immediately through the in-game 1:1 Support feature or by email at kraplo.x1@gmail.com, and follow our instructions. We are not responsible for losses that result from your failure to keep your login details secure, except to the extent that we caused them.
4.5 To protect Game Data and keep the Service stable, an Account can be active on only one device and one browser window at a time. If you sign in on another device, or continue playing in another window, the earlier session may be disconnected. The Service tells you when this happens.
5. Guest play
5.1 We may let you use part of the Service without registering, as a Guest. Guest play starts when you agree to these Terms and the Privacy Policy on the guest start screen.
5.2 Guest Game Data is linked only to an identifier stored in a cookie in your browser. You will lose access to your guest Game Data, and we cannot recover or transfer it, if:
- you clear your browser's cookies, or the cookie expires;
- you use a different browser or device; or
- the data is deleted under Section 5.3.
5.3 Guest Game Data is deleted automatically 30 days after your last visit. Each visit restarts the 30-day period. Because we have no contact details for Guests, we do not send individual notice before deletion; we display this rule on the guest start screen and in the game.
5.4 Some features are not available to Guests or are limited for Guests (for example, community posting and 1:1 Support). The in-game guidance describes the current limits. We may change these limits and will announce material changes in advance.
5.5 If you register an Account or sign in to an existing Account while playing as a Guest, we will ask whether you want to link your guest Game Data to that Account. We link it only if you choose to. Once linked, the data is treated as the Account's Game Data, and linking cannot be undone. Guest data that you choose not to link remains subject to Section 5.3.
5.6 These Terms apply to Guests in the same way as to Members, except for provisions that by their nature apply only to Members (such as those about Account information and Paid Services).
6. The Service
6.1 We aim to make the Service available 24 hours a day, every day, but we do not guarantee uninterrupted availability. We may suspend all or part of the Service temporarily for maintenance, repairs, upgrades, content updates or similar reasons. We will announce planned interruptions in advance where we reasonably can; where we cannot, we will announce them afterwards.
6.2 The Service is a live game that changes over time. We may add, change or remove content and features, and may adjust the performance, statistics, drop rates, prices in in-game currency and other values of Characters and Virtual Items to keep the game balanced and working properly.
6.3 We may discontinue the Service entirely for significant business reasons. If we do, we will announce it in the Service and notify Members by email at least 30 days before the Service ends. Section 8.8 explains what happens to unused purchases in that case.
6.4 We may display advertising in the Service. We will send marketing emails only if you have agreed to receive them. We may send you service messages (such as verification codes, security notices and replies to your support requests) without separate consent.
7. Virtual Items and in-game currency
7.1 Virtual Items have no monetary value outside the Service and cannot be exchanged for money or anything of value, except where we are required by law to give a refund.
7.2 When you obtain Virtual Items, whether through gameplay or through Paid Services, you receive a limited, personal, non-transferable, revocable license to use them within the Service in accordance with these Terms. You do not own Virtual Items or Game Data, and you may not sell, trade or transfer them outside the Service.
7.3 Virtual Items may be changed under Section 6.2, and may be removed if they were obtained in breach of these Terms or through a bug or error (see the Code of Conduct).
8. Paid Services
8.1 Some Virtual Items and time-limited services can be purchased for money in the in-game shop. Only Members can make purchases; Guests cannot. Purchases are currently not available to customers located in the European Union or the United Kingdom. We determine your location from the country of your PayPal account; if it is in one of these regions, we do not complete the payment and you are not charged. All free features of the Service remain available to you.
8.2 Prices. Prices are shown in US dollars (USD) in the shop, together with what the purchase contains and any usage period, before you pay. All prices include any applicable taxes, such as VAT, GST or sales tax. The amount shown is the total amount you pay us; your bank, card issuer or PayPal may charge separate fees, for example for currency conversion. We may change prices and the items offered; a change does not affect purchases you have already completed.
8.3 Payment. Payments are processed by PayPal. When you buy, you are redirected to PayPal's website to approve the payment, and you may be subject to PayPal's own terms. We do not receive or store your card or bank account details. The contract for a purchase is concluded when PayPal confirms to us that your payment has been completed, and the purchased items are delivered to your Account immediately after that confirmation.
8.4 Refunds of unused purchases. In addition to any rights you have by law, you may request a refund of a purchase through 1:1 Support within 14 days of the purchase. We will refund the part of the purchase that has not been used:
- if none of the purchased items or currency has been used, we refund the full price;
- if part has been used, we refund the unused portion in proportion to the price;
- if everything has been used, the purchase is not refundable under this Section. A time-limited service counts as used once you have claimed any of its paid benefits, or once its period has ended.
To work out what has been used, when you spend an item or currency of which you hold both free and purchased units, free units are counted as used first, and purchased units are counted in the order in which you bought them. Refunds are paid back through PayPal to the original payment method, and the refunded items are removed from your Account.
8.5 Right of withdrawal and immediate delivery (EEA and UK consumers). If you are a consumer in the EEA or the UK, you would normally have a statutory right to withdraw from a contract for digital content within 14 days without giving a reason. Because purchased items are delivered immediately, before you are sent to PayPal we ask you to confirm that you want the item delivered immediately after payment and that you understand you lose your right of withdrawal once it is delivered. A purchase cannot be made without this confirmation, and we record the time you gave it. Once the item has been delivered, the statutory right of withdrawal no longer applies. This does not affect the voluntary refund policy in Section 8.4, which continues to apply to unused items, or any other right you have under the law of your country. We will also give refunds wherever the law that applies to you requires it, including where a purchase is defective or not as described.
8.6 Chargebacks and payment reversals. If a payment is reversed, charged back or cancelled through PayPal, your card issuer or your bank, we may remove the items delivered for that payment from your Account. If you believe a charge is wrong, please contact us through 1:1 Support first so that we can resolve it.
8.7 If you are under the age of majority where you live, you must have the permission of a parent or guardian before making a purchase. Purchases made without such permission may be cancelled where the law allows.
8.8 If we discontinue the Service under Section 6.3, we will refund unused purchases (such as unused paid in-game currency or the remaining period of a time-limited service) as required by applicable law.
8.9 If we charge you by mistake or you are charged twice, we will refund the overpayment in full.
9. User Content
9.1 You are responsible for your User Content. You keep any rights you have in it.
9.2 You give us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display and distribute your User Content within the Service, only as needed to operate and improve the Service. This license ends when your User Content is deleted, except for copies we must keep by law or in backups that are deleted in the normal course.
9.3 We may remove, hide or restrict User Content, and may require you to change, or may change, a nickname or Character name, if we reasonably believe that it breaches these Terms, the Code of Conduct or the law — for example, content that defames or harasses others, is obscene or excessively violent, infringes others' rights, impersonates us or our staff, or is connected with crime. Where we do this, we will tell you the reason unless the law prevents us or the content is spam.
9.4 If you believe that content in the Service is illegal or infringes your rights, you can report it using the report button in the community or through 1:1 Support, or by email at kraplo.x1@gmail.com.
10. Intellectual property
10.1 The Service, including its game content, software, graphics, text and data (other than User Content), is owned by us or our licensors and is protected by intellectual property laws.
10.2 Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Service for your own non-commercial entertainment. You may not copy, modify, distribute, publicly display, reverse engineer or commercially exploit any part of the Service without our prior written permission, except where the law expressly allows it.
11. Prohibited conduct
You must not:
- register or update your information with false details;
- use another person's account, personal information or payment method without authorization;
- sell, buy, trade, lend or transfer Accounts, Characters, Virtual Items or in-game currency for real money or anything outside the Service, or broker such transactions;
- use bots, macros, scripts or other programs or devices that we have not provided to play the game automatically or to alter Game Data;
- exploit bugs, errors or vulnerabilities in the Service for your advantage instead of reporting them to us;
- send excessive requests, attack or overload our servers, or otherwise interfere with the operation of the Service;
- infringe our intellectual property rights or those of any third party;
- harass, threaten, abuse or persistently disrupt other players;
- impersonate us, our staff or any other person, or use our name without permission;
- post advertising, spam or unsolicited promotional content; or
- do anything else that is unlawful.
The Code of Conduct describes these rules in more detail and sets out the standard sanctions for breaking them.
12. Sanctions and suspension
12.1 If you breach these Terms or the Code of Conduct, or interfere with the normal operation of the Service, we may take action proportionate to the nature, seriousness, frequency and consequences of the breach. Actions include a warning, restriction of specific features, suspension for a fixed period, permanent suspension, and removal of Virtual Items or records gained through the breach. The Code of Conduct sets out our standard approach.
12.2 We will tell you the reason for a sanction and its duration. If a breach is continuing and we need to act immediately, we may act first and tell you afterwards. While your Account is suspended you can still sign in; you will see the reason and duration of the suspension, and you can use 1:1 Support to appeal.
12.3 You may appeal a sanction as described in the Code of Conduct. If we find that your appeal is justified, we will lift the sanction and restore anything removed as part of it.
12.4 If your Account is permanently suspended, we will not compensate you for Virtual Items or Game Data remaining in the Account. Unused paid Virtual Items will be handled as required by applicable law.
13. Ending your use of the Service
13.1 You can stop using the Service and delete your Account at any time from the Support section of My Page. Guests can delete their guest data in the same place. Deletion takes effect immediately and cannot be undone: your Account, Characters, Game Data, community posts and support history are permanently deleted. Some limited records, such as payment records, may be kept as described in the Privacy Policy. If you want a refund of an unused purchase under Section 8, please request it before deleting your Account, because we can no longer identify your purchases afterwards.
13.2 Self-service deletion is not available while an Account is suspended. During that time you can ask us to delete your Account through 1:1 Support, and we will handle the request as described in the Privacy Policy.
13.3 We may terminate your Account if you seriously or repeatedly breach these Terms or the Code of Conduct, or if Section 3 applies. Except where immediate action is needed, we will tell you the reason in advance and give you an opportunity to respond.
13.4 Sections 7, 9.2, 10, 14, 15, 18 and 19 continue to apply after these Terms end, to the extent relevant.
14. Disclaimers
14.1 To the extent permitted by law, the Service is provided "as is" and "as available". We do not promise that the Service will always be available, uninterrupted or free of errors, or that Game Data will never be lost, although we will restore Game Data lost through our fault where we are able to (see the Code of Conduct).
14.2 We are not responsible for failures or delays caused by events beyond our reasonable control, such as natural disasters, war, power failures, or outages of telecommunications or hosting providers.
14.3 We are not responsible for disputes between players or between you and third parties arising through the Service, although we may assist where appropriate. We are not responsible for any loss you suffer from trading Accounts or Virtual Items in breach of Section 11.
14.4 If you are a consumer, you have legal rights under the law of your country that these Terms do not affect. Nothing in these Terms excludes or limits any warranty, right or remedy that cannot be excluded or limited by law.
15. Limitation of liability
15.1 Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for our intentional misconduct or gross negligence, or for any other liability that cannot be excluded or limited by law.
15.2 If you are a consumer in the EEA or the UK, we are responsible for loss or damage you suffer that is a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill, as provided by the law of your country. We are not responsible for loss or damage that is not foreseeable.
15.3 Subject to Sections 15.1 and 15.2, and to the extent permitted by law: (a) we are not liable for any indirect or consequential loss, or for loss of profits, revenue, data or goodwill; and (b) our total liability to you for all claims relating to the Service is limited to the greater of the amounts you paid us for the Service in the 12 months before the event giving rise to the claim and USD 50.
15.4 You are responsible for loss or damage that you cause us by breaching these Terms, to the extent permitted by law.
16. Changes to these Terms
16.1 We may change these Terms to reflect changes to the Service, to the law, or to our business. We will publish the changed Terms in the Service with their effective date at least 7 days before they take effect. If a change is materially adverse to you, we will give at least 30 days' notice and will also notify Members by email.
16.2 If you continue to use the Service after the changes take effect, the changed Terms will apply to you. If you do not agree with the changes, you may stop using the Service and delete your Account under Section 13 before they take effect.
17. Notices
We may give you notices in the Service (for example, on announcement pages or through in-game mail) or, if you are a Member, by email to the address associated with your Account. Guests can receive notices only in the Service.
18. Governing law and disputes
18.1 If you have a problem with the Service, please contact us first through 1:1 Support or by email at kraplo.x1@gmail.com. We will try to resolve it informally.
18.2 These Terms and any dispute arising from them or from the Service are governed by the laws of the Republic of Korea. The Seoul Central District Court has jurisdiction over such disputes.
18.3 However, if you are a consumer, you keep the protection of any mandatory provisions of the law of the country where you live, and the choice of Korean law does not deprive you of that protection. You may also bring proceedings in the courts of the country where you live where the law of that country allows it. Consumers in the EEA or the UK can in particular rely on the consumer protection laws and courts of their country of residence.
19. General
19.1 If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions remain in effect.
19.2 If we do not enforce a provision of these Terms immediately, we do not waive our right to enforce it later.
19.3 You may not transfer your rights or obligations under these Terms to anyone else. We may transfer our rights and obligations to another organization as part of a transfer of the Service, provided this does not reduce your rights; we will tell you if this happens.
19.4 These Terms, together with the documents referred to in Section 1.2, are the entire agreement between you and us about the Service. These Terms are written in English. If we provide a translation, the English version applies to the English-language Service.
